A. Terms & Conditions

  1. The following terms and conditions apply to SmartPoints Loyalty Programme ("the Programme") which is organised by RHB Investment Bank Berhad ("RHBIB") starting from July 2015.

B. Eligibility

  1. This Programme is open to all online clients who maintains an Individual Online Trading Accounts for equities ("Eligible Participant").
  2. Online clients who hold Corporate Online Trading Accounts are not eligible to participate in this Programme.
  3. Proprietary Day Trader (PDT) and Investment Account Trader (IVT) trading equities are not eligible to participate in this Programme.
  4. Local Participants (an individual professional derivatives trader admitted/registered with Bursa Malaysia Derivatives Berhad) /trading Futures contracts are not eligible to participate in this Programme.

C. The Programme

  1. SmartPoints are automatically earned every time the Eligible Participant complete an eligible trade. An eligible trade is defined as:
  • An online trade on shares listed on Bursa Malaysia and Foreign Exchanges via online trading portal of RHB Investment Bank.
  • A trade done through dealer / remisier on shares listed on Bursa Malaysia and Foreign Exchanges offered by RHB Investment Bank provided that the Eligible Participant has an online equity account and has subscribed to receive statements via RHB TradeSmart or email.
  • An online trade via any futures online trading platform or an offline trade via Futures Brokers Representatives on any futures contracts offered by RHB Investment Bank.
  1. Eligible Participant is entitled to earn 1 SmartPoint on every RM1 brokerage on eligible trades. Calculation of SmartPoints for foreign trades will be determined on the RM equivalent based on prevailing foreign exchange rates, and is net off foreign fees and charges.
  2. SmartPoints earned by each Eligible Participant from all eligible trades defined above will be reflected on the SmartPoints History page accessible via https://smartpoints.rhbtradesmart.com
  3. All SmartPoints earned will expire after 3 calendar years from the date the points are credited or upon closure of all individual trading accounts, whichever is earlier. Example:

  5. SmartPoints are not transferable, nor exchangeable for cash, credit or kind.
  6. SmartPoints balance may be checked online HERE.
  7. SmartPoints will be credited to the Eligible Participant's account within 2 working days except for points earned during campaigns or promotions, which may be credited in accordance with the terms and conditions of each campaign or promotion.

D. General Terms and Conditions

  1. By participating in the Programme, Eligible Participant will be deemed to have read, understood, agreed, accepted and to be bound by all the Terms and Conditions of this Programme as stated herein including decisions of RHBIB which are final, binding and conclusive. The Eligible Participant further (i) agrees to co-operate and comply with all reasonable requests from RHBIB for the purpose of organizing, promoting and conducting the Programme; and (ii) consents to receive promotional, marketing and other publicity information from RHBIB from time to time.
  2. RHBIB reserves the right at its sole discretion to make changes or amendments to the terms of the Programme including but not limited to the number of SmartPoints earned by Eligible Participant at any point of time without having to give notice. RHBIB does not accept any liability of any nature in respect of the changes the terms of the Programme including but not limited amendments made to the number of SmartPoints earned by Eligible Participants. Any amendments to the terms of the Programme including but not limited changes to the number of SmartPoints earned shall not entitled the Eligible Participant to make any claims against RHBIB and accordingly RHBIB shall not compensate Eligible Participant for any such changes.
  3. RHBIB reserves the right, in its sole discretion, to disqualify any Eligible Participant and/or to forfeit any SmartPoints from an Eligible Participant it believes has undertaken fraudulent practice and/or activities or other activities harmful to this Programme or the Programme submission process.
  4. The Eligible Participant agree that by providing personal information has consented that RHBIB shall process his personal information for any and/or all of the following purposes ("Purpose"), if applicable:
  1. Administering this Programme and contacting the Eligible Participant in relation to the same;
  2. cross-selling, marketing and promotions of products and/or services of RHB Banking Group and its strategic alliances; or
  3. other related and legitimate business purposes

Agree that the Eligible Participants' personal information may be disclosed to other companies within the RHB Banking Group (which shall include its holding company, subsidiary(s), and any associated company(s), including any company as a result of any restructuring, merger, sale or acquisition), service providers, and vendors and any of their respective agents, servants and/or such persons whether located within or outside Malaysia for the Purpose, if applicable, subject at all the times to any laws (including regulations, standards, guidelines and/or obligations) applicable to RHBIB.
  2. May exercise their options in respect of receiving marketing materials (including cross selling, marketing and promotions as described above) by contacting us through the RHBIB Contact Details.
  3. May request for correction (if the personal information is inaccurate, outdated, incomplete, etc.) access to, or deletion of the Eligible Individual Participant personal information.
  4. RHBIB reserves the right to publish or display the name, picture, identification numbers, photographs or other information of all the winners for advertising and publicity purposes without compensation.
  5. RHBIB reserves the absolute right at any time without assigning any reasons to add, alter, modify, change or vary the Programme Terms and Conditions contained herein, wholly or in part at its absolute discretion.
  6. RHBIB reserves the absolute right at any time without assigning any reasons and or without prior notice thereto to cancel, terminate, postpone or suspend indefinitely the Programme. Any cancellation, termination or suspension of the Programme by RHBIB shall not entitle the Participant to any claim or compensation against RHBIB for any loss or damage incurred by the Participant as a direct and indirect result of such cancellation, termination or suspension.
  7. RHBIB and its respective affiliated companies are not responsible for and shall not be liable for: any default in respect of the Programme due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, storm, technical or system failures or any event beyond the reasonable control of RHBIB.
  8. RHIBIB decisions on all matters relating to the Programme including the determination of Eligible Participant and the SmartPoints shall be final and conclusive. No correspondence, queries, appeals or protests shall be entertained.
  9. A failure by RHBIB to enforce any of these Programme Terms and Conditions in any instance(s) will not give rise to any claim by any person.
  10. RHBIB shall not be liable, whether direct or consequential, for any loss and damage or whatsoever suffered by Eligible Participants caused by directly or indirectly, in whole or in part, from their participation in the Programme as a result of any act or omission on the part of RHBIB.
  11. RHBIB shall not be responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or contestants on account of technical problems or traffic congestion on the internet or at any website or combination thereof, including any loss or damage to the Participants or to any other person's computer related to or resulting from participating in this Programme.
  12. The Terms and Conditions shall be governed by, and construed in accordance with, the laws of Malaysia and the parties hereby submit to the exclusive jurisdiction of the courts of Malaysia.

  14. In the event of any inconsistencies between these terms and conditions and any brochure, marketing or promotional materials relating to the Programme, these terms and conditions shall prevail.
